Burden of proof of facts and claims
Description
Book Introduction
It has been 14 years since the publication of this book, which is based on the major substantive provisions of the Civil Code and the Commercial Code, and comprehensively covers related issues in the Civil Procedure Act and the Civil Execution Act, focusing on Supreme Court precedents.
As has been done annually, 2025.
7. 1. Cases published in the case law bulletin for the past year up to 2025.
6. Added Supreme Court precedents pronounced up to 26.

The sections on 'Methods of Interpreting Individual Legal Terms' and 'Confirmation of Applicable Laws through Application and Interpretation of Supplementary Provisions', which were previously written in the previous edition in accordance with civil law cases, have been significantly supplemented by further detailing the content and adding a wealth of precedents from numerous cases.
In the section on 'Methods of Interpreting Individual Legal Terms', 'Specific examples of interpretation of individual statutory terms' were added, such as 'Distinction between the statute of limitations period and the period of limitation', 'Distinction between filing a lawsuit and continuing a lawsuit', 'Whether the legal phrase "good faith" can be interpreted as "good faith and no gross negligence", "good faith and no negligence"', 'Meaning and interpretation of "etc.", "Other (other) cases of ~", "Similar to ~"', 'Interpretation of before/after and before/after, more than/less than and majority, exceeding, less than, and falling short', 'Interpretation of temporal elements such as past, present, and future tenses, points in time, and periods', 'Meaning of "~ is" and "~ can be"', etc. In the section on 'Confirmation of Applicable Laws', 'General reference point in time for application of laws', 'Prohibition of deprivation of property rights by retroactive legislation', 'Decision of unconstitutionality and applicable laws' were added, and 'Scope of temporal application of precedents' was newly added. Added.
Although this is a basic and practical guide, I hope it will be of some help in areas where there has been a lack of reference materials.
In addition, new sections such as ‘domestic agency between spouses, legal agency of a parent for a minor’, ‘loss of trust interest and loss of performance interest’, ‘order of inheritance of the deceased’s claim for damages and deduction of survivor’s pension’, ‘joint liability for payment of wages in subcontracting’, ‘claim for insurer subrogation’, and ‘payment of support and claim for indemnity’ were added, and the sections on ‘indemnity debt’, ‘claim for interest’, and ‘association’ were significantly supplemented.
