Why a courtroom and not an academic space or a plaza?

“The ‘Comfort Women of the Empire’ lawsuit incident is a case in which discussions that should have taken place in academic settings were forced to take place in a court of law.
The Korean and Japanese "intellectuals" who were critical of me not only did not invite me to the public sphere during this period, but they also turned a blind eye to the public's witch-hunt accusations and the trial.
(…) This book is my first attempt at a ‘public forum’ that I created myself because the academic world did not create it.” (p. 6)

On June 16, 2014, Professor Park Yu-ha, author of 『Comfort Women of the Empire』, who was sued in civil and criminal cases and requested an injunction, including a publication ban, on charges of "defamation through publication" in the name of nine former comfort women, simultaneously published a book titled 『[Comfort Women of the Empire], 1460 Days in Court』, which organizes the background and process of the lawsuit that has been ongoing for four years since the lawsuit was filed, and a book titled 『[Comfort Women of the Empire], Speaks of Intellectuals』, which contains rebuttals to criticisms from scholars in Korea, Japan, the courts, and academia before and after the lawsuit.


As of June 2018, the criminal case for ‘defamation by false statement’ was ‘not guilty in the first trial, guilty in the second trial - 10 million won in fines’ and is currently on appeal to the Supreme Court. The injunction application was ‘partially accepted’ in February 2015, and Professor Park Yu-ha and the publisher issued the ‘2nd edition with 34 deleted places’ along with an ‘objection’. The civil damages claim lawsuit is currently on appeal after being sentenced to ‘10 million won in damages per plaintiff’ in the first trial.

Into the book
The reason such voices have not been heard until now is because there was no one willing to listen, and furthermore, the speakers themselves felt oppressed, not allowing other voices to be heard.
In other words, the “usurpation of testimony” that Jeong Yeong-hwan claims often occurs among people with the same attitude and way of thinking as Jeong Yeong-hwan.
I pointed that out in this book, and the lawsuit was the beginning of the oppression of those who had oppressed the 'comfort women'.
Therefore, the criticism that my “method” “misses the tension between ethics and the subject” and is “not an appropriate way to write history” only reveals that Jeong Yeong-hwan completely fails to understand my “method” of approaching the subject of his research. --- p.122

Jaeseung Lee also criticized me in an article published in the summer of 2015, saying that I “deny violations of state norms and also deny direct responsibility for the state.”
But I have never denied 'direct responsibility'.
(…) Lee Jae-seung must face that truth first.
Only then will we come to understand the limitations of relying on the ‘law’ to judge all issues.
'Comfort women' were outside the state's benevolent 'law' that applied to not only men subject to conscription and other types of military service, but also other women, such as nurses.
Lee Jae-seung's "legal supremacy" fails to recognize that this is a social discrimination against their "work" and ultimately a class issue. --- p.33

Just as Park No-ja previously linked Ukraine and Japan without any basis, he is suddenly equating Korea and Japan without any context.
(...) Park No-ja completely overlooks or ignores what she wrote in 『Comfort Women of the Empire』 about the meaning of the fund or the Prime Minister's letter.
The only reason he ignores them is the baseless assumption in his head that “South Korea = Gangsters = Japan.”
Such harsh regulations seem to lead him to regard "Comfort Women of the Empire" as a book that "calls for forgiveness for the rogue state of Japan" and "ultimately signifies a positive acceptance of the rogue state of South Korea." --- p.66

Of course, the reason for looking at it is not to dilute Japan's responsibility, but to accurately understand the 'comfort women' issue.
The fact that Jeong Yeong-hwan's criticism is a misinterpretation that goes beyond genuine questioning is clearly revealed in his point that "the above quotation can also be read to mean that there would have been no problem with the military comfort women system if the supply had kept up" (481), while quoting my article criticizing the very act of creating demand, that is, starting a war.
Even Jeong Yeong-hwan's malicious interpretation, writing that "if only the operators' deviations are questioned, it would be a natural logical consequence to exempt the military comfort station system itself from responsibility" (481), reveals serious problems with his thought processes and argumentative style. --- p. 129

I wrote that it was the male-centered, patriarchal, and imperialistic discrimination against women/ethnicity/class/prostitution of the modern nation-state that created the comfort women, and that Japan should recognize that this was a problem with the system of the modern state and apologize/compensate for the comfort women.
However, Jeong Yeong-hwan falsely claims that "Park Yu-ha approves of the Japan-Korea annexation, protects the 1965 system, and does not recognize the individual claims of the comfort women."
(…) I think Jeong Yeong-hwan’s distortion is at a criminal level.
Furthermore, Jeong Yeong-hwan's "method" of criticism is a direct copy of the criticisms of other Zainichi Koreans, such as Seo Gyeong-sik and Kim Bu-ja. --- p. 116-117

In fact, as the issue of coercion in the form of soldiers being dragged away was accepted, the discussion shifted to 'human trafficking', and even Professor Yoshimi spoke of 'structural coercion'.
However, the concept of ‘structural compulsion’ was exactly the concept I used in ‘For Reconciliation’ (2005).
However, critics, including Jeong Yeong-hwan, do not hesitate to misinterpret and distort my book beyond dismissing it as non-existent or emphasizing only the parts they find unsatisfactory.
Even recently, they have used my suggestion that this issue should be viewed as a colonial rule issue without citing it, yet they never mention that the subtitle of "Comfort Women of the Empire" is "Colonial Rule and the Struggle of Memory." --- p.124

Jeong Yeong-hwan summarizes what I said about the comfort women issue: “We cannot hold the Japanese state responsible” (480).
However, I did not say that the Japanese state is not responsible; I only said, “If you want to hold them legally responsible, you should first hold the business responsible.”
Nevertheless, Jeong Yeong-hwan distorted my argument, and his distortion spread throughout Korean society through social media and the media without any verification.
The reason I focused on the existence of intermediaries such as ‘dealers’ is not to deny the responsibility of the Japanese state.
This is because they are the ones who perpetrated the brutal violence and forced labor and profited from it.
Also, kidnapping and fraud were punishable even at that time.
Above all, it is because the ‘hatred’ towards comfort women is directed towards them.
The difference between me and the critics lies in whether or not we tried to see the diversity of hatred towards comfort women.
The reason critics like Jeong Yeong-hwan are uncomfortable with such criticism is because, whether they are conscious of it or not, it is a criticism of Korea/men.

Those intellectuals simply tried to preserve existing movements and research.
However, there are three things you must keep in mind when considering this lawsuit.

First, who is the subject of the lawsuit?
Second, is 『Comfort Women of the Empire』 really, as the plaintiffs and prosecutors claim, a book that “denies forced conscription and calls comfort women ‘prostitutes who went there voluntarily’”?
Third, if that is not the case, as the not guilty verdict in the first criminal trial suggests, then why on earth did the plaintiff and the prosecution file a complaint and indict Professor Park?
Since the accusation, countless people have criticized Professor Park Yu-ha, believing only the plaintiff and the prosecution's claims without verifying these basic facts, without reading the book, or through confirmation bias.
However, to talk about the 『Comfort Women of the Empire』 lawsuit, an accurate judgment on these three things is first necessary.

And more importantly, the author, who felt sorry for the extremely poor state of research on the comfort women issue in Korea compared to the level of interest (our understanding of the 'comfort women issue' has in fact relied on more than 90% of research by the Japanese), published a book that was merely the result of his own research and reflection/reasoning, and when it became the subject of civil and criminal lawsuits and prosecution by the state, how did 'intellectuals' respond, and how were they involved before that?
The author, Professor Park Yu-ha, says:

“I simply represented the ‘other voice’ of the comfort women grandmothers.”
“They just wanted to preserve the existing movement and research.”
“The prosecutor’s request for a ‘three-year prison sentence’ was created by those ‘intellectuals.’”
After the lawsuit was filed, there was criticism and finger pointing from countless media outlets, the public, politicians, and scholars, but at the center of this were activists, scholars, and feminists related to the comfort women issue, so to speak, mainstream figures in the comfort women issue.
They were directly or indirectly complicit in the state's punishment of individuals, and no one objected to the excessive public criticism, even though they knew better than anyone that "Comfort Women of the Empire" was not in line with the claims of those who "deny" the comfort women issue.
Of course, no one asked for the lawsuit itself to be withdrawn or for the attacks on Professor Park Yu-ha to stop.
They sometimes joined in by spreading the image of a phony scholar with the plausible expression, “I’m against going to court, but the book is nonsense,” or by going a step further and treating him as a “Japanese right-winger,” a “Nazi,” or a figure similar to “Eichmann,” or by leaving those who criticized him with such words alone.

The Current State of the Comfort Women Issue and Intellectuals
This book exposes how the "intellectuals" behind the scenes of the support group "Nanum's House" have been involved in and supported this lawsuit.
And beyond simple rebuttals, it analyzes what kind of thinking of 'intellectuals' led to such criticism.
The author says:
Even the so-called 'intellectuals' criticized/condemned things based on their own 'common sense', but they did not know how to have a 'reserved' attitude when encountering unfamiliar research methods.

In fact, 『Comfort Women of the Empire』 was also a sharp critique of the document-centeredness and stereotypical victim-centeredness of the historical academia.
The enthusiastic response to "Comfort Women of the Empire" in Japan stemmed from the sympathy for the new perspective it presented, and in academic circles, many scholars beyond their own fields praised the cutting-edge nature of the effort.

For several years now, Western/Japanese academic circles have been publishing research written from a different perspective than previous studies on the comfort women issue.
At the end of the book, the author quotes an academic book titled “Towards a Comparative History of War and Sexual Violence” published in Japan in February of this year, and says:


“It was this very realization that led me to write ‘Comfort Women of the Empire.’
I believe that the criticisms of scholars who wanted to dismiss the testimonies cited in “Comfort Women of the Empire” as “exceptions,” or even worse, as lies, were ultimately the result of a lack of awareness of this aspect.

So we can say it again:
You can't discuss the 'comfort women issue' and 'intellectuals' in Korean society without reading this book.
