Preface

The Seoul Administrative Court, Korea's only specialized court handling public law disputes, published the first edition of its practical guide, "Theory and Practice of Administrative Litigation," in 2008, which comprehensively covers basic and advanced theories related to administrative litigation, as well as trial procedures and specific trial methods for each type of lawsuit, based on accumulated practical experience and research findings.
In 2013, we added new sections on refugee, nationality, immigration law-related litigation, construction and disciplinary litigation, and resident litigation, which were not included in the first edition. In 2016, we published a revised edition with additional sections on health and medical litigation, private school litigation, and litigation related to restrictions on bidding qualifications.
"Theory and Practice of Administrative Litigation" is widely regarded as the most systematic and comprehensive guidebook on administrative litigation, and has long been beloved by practitioners. It has also contributed to the establishment of the rule of law, securing the legitimacy of administrative action based on it, and protecting the fundamental rights of citizens.

However, as practical developments continued, new fields emerged, and legal revisions and new precedents accumulated, the need for revision and supplementation grew by the day.
Accordingly, considering the increasingly large volume and the difference in the speed of revision work, it was decided to separate the previously single-volume books into separate volumes by field. Accordingly, in 2021, "Theory and Practice of Administrative Litigation I" dealing with the field of "Urban Planning and Health/Medical Care" will be published, in 2022, "Theory and Practice of Administrative Litigation II" dealing with the field of "Land Expropriation, Refugees, and School Violence" will be published, and in 2025.

This book is the sequel to "Administrative Litigation Theory and Practice IV," and covers various dispositions related to the Nationality Act and Immigration Control Act that were not covered in the previous book, as well as general administrative regulations such as driver's licenses, business suspensions, information disclosure, architecture, teachers, disciplinary actions, and recently highlighted administrative litigation in the field of school violence, restrictions on bidding, and compensation.


These fields not only occupy a significant portion of administrative litigation practice but are also closely connected to the daily lives of citizens. However, systematically organized practice guidelines have not been readily available.
In this writing process, we took this into consideration and systematically organized the laws, case law, and practical examples in each field to cover as comprehensively as possible the types of litigation and issues at stake. We also collected and organized as much lower court precedent as possible to provide practical guidance for conducting trials and related work in this field.
It is also very significant that the series on the theory and practice of administrative litigation has been completed in four volumes with this book, thus completing a practical guide that covers all aspects of administrative litigation.


I would like to express my deepest gratitude to Judges Lee Sang-deok and Ko Eun-seol, who spared no effort in reviewing this book despite their busy trial schedules to further enhance its quality; to the current and former judges of the Seoul Administrative Court who took charge of each chapter and did their best to write it; and especially to Chief Justice Kim Kook-hyun of the Seoul Administrative Court, who consistently provided great interest and guidance throughout the entire process with great affection.
