If I were to make a new law
Description
Book Introduction
As a citizen and owner of the country
The minimum legal knowledge you must know
Louis XIV, the Sun King of France, said, "I am the state."
Louis XV, who succeeded him, also believed that the legislative power to make laws belonged only to him.
In a time when the king's word was law, politics for one person led to war and luxury, leaving the people suffering and starving.
Eventually, a revolution occurred in France, and the absolute monarch, who was not subject to the constraints of the law, was driven from the throne by the power of the people.
Today, our Constitution first and foremost states that all power in the Republic of Korea emanates from the people.
The author, a constitutional scholar, asks, “We are the masters, so to whom will we entrust the justice of the law?”
Because democracy can only be preserved when the people fulfill their role as masters.
This book explains in simple terms what the law is and why we need to know the law, from a perspective that young people can understand.
By looking at the history of mankind, we lead you to first understand the big picture of the law and build basic knowledge.
In addition, it helps students develop a proper legal awareness by introducing them to the world of various professions that create and enforce laws, such as members of the National Assembly, presidents, judges, and prosecutors.

Into the book
Game of Thrones was a bloody story of citizens fighting for sovereignty against absolute monarchy.
Although it may be slightly different in each country, it was a life-threatening struggle to live as the master of the country, not as a slave.
As a result of this struggle, today's Constitution embodies the spirit of popular sovereignty, which means that sovereignty resides in the people.
--- p.24
But can constitutional amendments alone protect the people's fundamental rights? This has prompted concerns about what we should do to prevent fundamental rights from being trampled upon again by the absurdities of those in power.
The answer was to establish a mechanism to protect the Constitution.
It was the emergence of a constitutional court that would examine the constitution using the yardstick.
As a result, the Constitutional Court was established through a constitutional amendment in 1987.
--- p.56
The principle of legality is that the standards for crimes and punishments should be determined solely by law.
This embodies the modern idea that individuals' lives and property must be protected from the public power of the state or public organizations.
According to the principle of legality, the state determines the presence or absence of a crime and the type of punishment through laws agreed upon by society, and exercises coercive power.
--- p.70
The presumption of innocence does not necessarily have to be observed only in court.
In reality, there are many cases where defendants on trial are treated as if they were already convicted due to public opinion.
The so-called trial by public opinion, which determines a trial based on public opinion regardless of the truth of the case, is against the spirit of the Constitution.
--- p.91
For example, if you choose milk at a convenience store and take it to the checkout counter, you are making an offer to buy milk, and a contract is formed when the convenience store employee accepts the price of the milk.
Even taking a bus or buying a novel is a contract through subscription and acceptance.
Most of our daily lives revolve around these contracts.
Countless legal transactions occur every day.
We live on the foundation of civil law, although we may not be aware of it.
--- pp.109-110
In the past, match factories made matches with a toxic substance called white phosphorus.
The girls were exposed to toxic substances without protective equipment such as masks in a poorly ventilated factory.
His lower jaw collapsed, his face became hideous, and he eventually died.
At the factory, if the girl's face was seen to turn even slightly dark, they would give her a match and kick her out.
It was to hide an industrial accident.
--- p.144
For the human dignity and happiness guaranteed by the Constitution to be realized, there must be a helping hand ready to be extended in times of crisis.
That warm hand could be a welfare policy or redistribution through multifaceted support.
Among them, the Social Security Act comes to us like the sunlight that embraces all things.
One of the core principles of social law is a humane life for all of us, and social security law guarantees this.

Publisher's Review
From the Constitution to social law
The power of law to change the world
We made a promise called law to live together.
Examples include the Constitution, which paved the way for freedom and equality, the criminal law that defines crime and punishment, the civil law that protects family and property, and social law that promotes a humane life.
What if the law threatens my daily life? Can we be happy in an unjust society?
The fastest way to achieve social justice is through public interest and participation in the law.
In 2005, the male-dominated, male-centered, head-of-the-household system disappeared into the annals of history.
It was the result of the people's will to create an equal family relationship without a separate owner.
Rather than blindly following even bad laws, we must keep in mind that laws can be changed and re-created at any time.
Changing the world begins with a powerful process of reexamining and changing each and every law.
This is why the book emphasizes connecting the law to our daily lives.
The era of the 4th industrial revolution,
As an awakened youth citizen
During the Industrial Revolution, Britain had anti-union laws.
Even if two people met and talked, it was considered a forbidden act, and workers were treated like servants.
The familiar stories of The Little Match Girl and Oliver Twist were created against the backdrop of various social problems, such as the gap between rich and poor and labor exploitation, brought about by the actual Industrial Revolution.
Today, we are living in the era of the Fourth Industrial Revolution, thanks to the advancement of information and communication technology.
It may be time to rethink work and career.
At the same time, legal education is necessary to avoid repeating the tragedies of the last industrial revolution. With the surge in crimes targeting youth on social media, young people, as citizens, must develop a legal mindset early on, one that allows them to view the world through the lens of the law.
After learning the meaning and role of the Constitution, criminal law, civil law, and social law through this book, you will come to appreciate the importance of law that permeates our daily lives.
